Wrong-Way Route 22 Driver Was Drunk, Say Police

March 20, 2020 by Matthew Reisig

Around one in the morning on February 17, Bridgewater police stopped an eastbound vehicle in the westbound lane of Route 22 in Bridgewater. Behind the wheel, they found 24-year-old Erick Torres-Martinez, of West New York, who appeared to be intoxicated. Torres-Martinez had other problems going for him, as well, including that he doesn’t have a driver’s license.

He was arrested at the scene and taken to Bridgewater Police headquarters for processing. Torres-Martinez was charged with DWI, reckless driving, driving the wrong way on a one-way highway, and being an unlicensed driver. He was released later with a pending court date.

New Jersey Appeals Court Tired of Your DWI Appeals

February 20, 2020 by Matthew Reisig

This seems like a hazard of the job, but a state appeals court in New Jersey has gone out of its way to publish a sternly worded ruling affirming the propriety of police charging people with DWI if the suspect is sleeping or passed out drunk at the wheel of a parked car.

This is longstanding law in New Jersey, but the three-judge panel noted that it has faced objections to the status quo no fewer than seven times in the last twelve months, representing a significant uptick in attempts to overturn the existing regime.

The gist of the arguments the court has heard recently are that police can’t prove the person was impaired when they got into the car, and that while sleeping, they are not capable of forming an intention to operate the vehicle.

The appellate court wasn’t interested in this particular logic, but the judges might want to get used to fielding these types of questions. With a slate of reforms recently enacted, defendants and lawyers may want to continue pushing the envelope to encourage further changes.

Drunk Driver Strikes Pole in Upper Saddle River, NJ

February 12, 2020 by Matthew Reisig

A lot of people choose to stay in to relax and refresh rather than going out, in part to steer clear of potential drunk drivers. Maybe this isn’t a huge consideration at 4 p.m. on a Monday, but the idea holds.

So imagine the feeling among residents in the Orchard Drive and Lake Street neighborhoods in Upper Saddle River on February 10 when an allegedly drunk driver struck and knocked down a utility pole, leaving many addresses in the area without power or cable for hours.

At the scene, 23-year-old Zunnan Chudry was arrested and ultimately charged with DUI, reckless driving, and failing to report an accident. He was released to a sober adult after processing at the Upper Saddle River police department.

If you’ve been arrested for DWI in New Jersey, an experienced DWI defense lawyer can make a big difference in your case.

Call Matthew Reisig today at 732-625-9660 to learn how he’s helped more than 1,400 New Jersey residents avoid conviction on DWI and related charges.

Mahwah Mayor Drove Drunk to Employee Party, Passed Out Naked in Employees Bed, Anonymous Source Complains

February 6, 2020 by Matthew Reisig

Town employees in Mahwah Township are asking for the town council to take action against Mayor John F. Roth after a letter entitled, “Concerned Employees of the Township of Mahwah” was obtained by the press. The letter recounts how a township employee threw a party at her home, with 20-25 attendees. The Mayor is said to have driven to the party drunk, consumed more alcohol at the party, and after disappearing, was discovered “undressed sleeping in” the hostess’s bed.

The incident, according to the letter, sparked embarrassed gossip in township offices, as well as an effort by the mayor to cover it up. The letter writer says that Roth’s actions have created a “toxic and hostile workplace” that has “already caused issues in the office which make it nearly impossible to work collectively.”

The Township Council is investigating, but has no authority to fire Roth. Voters have recalled mayors in Mahwah’s recent past. In fact, in 2016, voters recalled former Mayor Bill Laforet, who was subsequently defeated by Roth to hold the seat.

It sounds like Mayor Roth avoided a DWI stop, but may find himself in much hotter water as a result. If you’ve been stopped for DWI in New Jersey, get the help you need to keep moving forward. New Jersey Driver Goes Out of His Way for New York DWI

February 4, 2020 by Matthew Reisig

Why party at home when you can party out on the town? Well, it turns out that for one Hillsborough driver, it might have been better to just stay in. After a Saturday, January 25 traffic stop around 10 p.m. on I-87 outside of Tarrytown, New York, 40-year-old Pedro Cruzgonzalez is facing a lot of trouble.

State Troopers in New York saw the car Cruzgonzalez was driving allegedly commit a vehicle and traffic violation, resulting in the stop. Troopers quickly began to suspect that the driver was intoxicated, so he was arrested and taken to New York State Police barracks at Tarrytown.

Unfortunately for Cruzgonzalez, a breathalyzer test is reported to have come back with a blood alcohol content exceeding .20, or more than twice the legal limit in New York. Things didn’t get better for him, either.

Troopers soon realized that Cruzgonzalez is a second time offender in the past 10 years, which makes his charge a felony level aggravated driving while intoxicated offense. Cruzgonzalez was released to a sober friend and will respond to the charges in February.

If you’re a New Jersey resident who’s been stopped for DUI out of state, it can really help to talk to a lawyer in New Jersey. After all, just like you can travel, so can the penalties of a drunk driving conviction in another state.

Scotch Plains Police Had a Vigilant New Year’s Eve

January 22, 2020 by Matthew Reisig

In another “be careful driving on New Year’s Eve” story, a Scotch Plains man was arrested for DWI after a motor vehicle stop on December 31.

While police are always watchful when it comes to drunk driving, that night in particular is one where it can be assumed that many of the people on the road have had a drink…. or a few.

Dennis M., 50, was allegedly in that category when Patrolman Mike Baltazar of the Scotch Plains police pulled him over. Baltazar determined that Moore was likely intoxicated, and he was arrested, transported to headquarters, and charged with DWI.

DWIs happen all year long, and whenever you find yourself facing one, a lawyer is your best bet at protecting your rights and preserving your freedom. Call Matthew Reisig today at 732-625-9660 for a free consultation with an experienced New Jersey DWI defense lawyer.
