Doesn’t The Alcotest Have Software Problems In New Jersey?

Yes, and these issues have been litigated to the New Jersey Supreme Court twice.

In the first case, the court found that there are known problems that must be resolved by the state, and in the second case, the court carved out an exception for some groups of people who might be unfairly convicted because of design or software flaws.

Though the court has approved continued use of the Alcotest device, know that every chemical test in New Jersey must be administered under strict protocols, and there is no such thing as a “slam dunk” DUI case.

In New Jersey, Will An Arrest For DUI Be Something Employers Will See?

The good news about DWI arrests in New Jersey is that they don’t leave you with a public record that employers can generally see.

If you’ve been arrested for DWI and are currently job hunting, you may answer the question, “Have you ever been arrested?” with a “No.”

If the application asks you for a history of traffic violations, that is where you would list your New Jersey DWI.

If I Refuse a Breath Test In New Jersey, What Happens To Me?

Refusal to submit to chemical testing when police suspect DWI carries many of the same penalties as the DWI itself.

By carrying a driver’s license, or just operating a motor vehicle on a public roadway, the state of New Jersey presumes that you give consent for the testing of blood, breath, or urine when you are suspected of operating a vehicle while intoxicated.

Being convicted of refusal the first time can cost you big. First, the state can rescind your driving privileges for a period of seven months to up to two years.

You’ll be required to attend the Intoxicated Driver Resource Program (IDRC) at a cost of $230 a day.

Fines will run from $300 to as much as $1000, and various other fees and surcharges apply.

Don’t I Have A Fifth Amendment Right To Refuse Breath Testing In NJ?

This is an interesting question, because yes, you have a right to refuse to give samples of breath, blood, or urine when the police ask for one and they cannot, under the law, physically restrain you to force you to surrender the samples.

That’s true in DUI/DWI cases as well as every other matter the police may be involved with, and that right to refuse is a core component of what it is to be an American.

But here’s the other side of refusal: A state-issued driver’s license is not an inalienable right in New Jersey or the United States.

When you apply for and receive a driver’s license in New Jersey, you are giving your consent to chemical testing when police suspect intoxication.

Because you have previously given your consent, if you later choose to refuse, you may be charged with refusal, which carries many of the same penalties as DWI, and as an added bonus, you may still be convicted of drunk driving!

Is There A Difference Between DUI And DWI In New Jersey?

No, DWI (Driving While Intoxicated) is how New Jersey describes the offense commonly referred to as “DUI.”

Unlike most states though, New Jersey doesn’t prosecute DWI as a criminal matter, so a conviction for DWI can have less impact on your future than it might in other states.

That doesn’t mean there are no penalties though. You’ll still have to deal with a suspended license, big fines, and possibly even jail time if you’re convicted of DWI in New Jersey.

Do I Need To Worry That Potential Employers Will See The DWI On My Record In New Jersey?

In most cases, you do not need to worry about job hunting and a past DWI.

Because New Jersey doesn’t treat DWI offenses as criminal charges but as traffic charges, a potential employer won’t necessarily see the DWI when performing a standard criminal background check.

That said, many employers ask about traffic offenses on their applications, and because your driving record is available to the public, you should be honest if the question is asked.

And if you apply for a job requiring a commercial driver’s license, you’re very likely to have a tough time securing employment in that role after a DWI, even years later.

Additionally, professional licensing boards in New Jersey and in other states may pursue sanctions after a DWI conviction.

Your best bet with a DWI conviction is to avoid one entirely.
