How Long Will A Past DWI Conviction Count Towards My Current DWI Case In New Jersey?

In New Jersey, a past DWI conviction can significantly impact any future DWI charges you face. New Jersey has a “step-down” provision that dictates how long a prior conviction counts toward your current DWI case.What Impact Does A DWI In The Past Have On A Current Arrest

This provision allows for less severe penalties if a long enough period has passed since your last conviction. Specifically, if more than 10 years have gone by between your first and second DWI offense, the second offense may be treated as a first offense when it comes to penalties. The “step-down” rule applies to both second and third offenses. As a base proposition, you’ll face additional fines of $500, up to two years additional license suspension, and a jail sentence of 10 to 90 days.

Can I Get The Surcharge Waived In My New Jersey DWI If I’m Out Of Work?

No, your judge almost certainly won’t waive the surcharge payment you’ll owe to New Jersey’s Motor Vehicle Commission.

If you’re convicted of DWI, you’ll owe $1,000 a year for the next three years, even if you’re out of work or underemployed.

Even worse, if you fail to pay your surcharges, your license will be suspended, and ultimately a judge will allow the MVC to collect through involuntary means.
