How Long Will My License Be Suspended For If I’m Convicted Of DWI In New Jersey?

License suspension is mandatory in New Jersey after a DUI conviction, but the time frame varies based on two factors.

First, if your blood alcohol content was over .08 but under .10, your penalty will be lower.

Second, the number of previous DWI’s you’ve been convicted of will be a determining factor. There are additional considerations if you were under 21 at the time of the arrest.

If this is your first offense and your BAC was .08 or higher but under .10, your mandatory suspension is 3 months.

If your BAC was .10 or higher on a first offense, you may lose your license for up to a year.

The window for a second (or third) DWI is 10 years, so if this is your second arrest for DWI in a decade, you’ll face a license suspension of two years.

For a third offense, you can lose your license for 10 years.

You don’t have to be convicted of DWI in New Jersey, and few cases are as airtight as police and prosecutors want you to believe.

What Is DUID And How Is It Different From DWI In New Jersey?

New Jersey classifies intoxicated driving offenses at least two ways.

In a DWI arrest, you are suspected of operating a vehicle under the influence of alcohol, and you are required to submit a chemical test (usually breath) under the state’s Implied Consent law.

In a DUID arrest, you are suspected of being under the influence of drugs, including illegal substances like cocaine, heroin, or marijuana, as well as prescription drugs that may impair safety on the road.

Drivers arrested for DUID are not subject to the implied consent law, and do not have to supply a chemical sample unless they hold a commercial driver’s license.

Testing will be performed by a Drug Recognition Expert, a specially trained police officer, and the prosecution is not under an obligation to prove the substance you were under the influence of.

It’s important that you work with an experienced DUID attorney if you’ve been arrested on these charges, because the lower bar of proof can be a serious hurdle in court.

How Long Will I Have To Use The Ignition Interlock Device After A First DWI In New Jersey?

How long you’ll be required to lease, maintain, and use an Ignition Interlock Device (IID) in New Jersey correlates directly with whether you are a first, second, or third offender.

For first offenders, the judge may, or may not, order you to use the device for six months to a year once your license is reinstated.

If your BAC was above 0.15%, the judge has no discretion in the matter. You will be required to use it for six months to a year.

This isn’t simply an inconvenient punishment when it comes to starting your car.

You’ll have to pay to lease the device from one of a handful of companies in New Jersey licensed to install them, and every 30 days, you’ll have to take your car in to have the device calibrated, and you will pay the bill.

When Is The Ignition Interlock Device Required After A DWI Conviction In New Jersey

Contrary to what you may have heard, the Ignition Interlock Device (IID) is not a mandatory component in all DWI convictions.

For first offenders, an IID is usually only ordered where the driver’s blood alcohol content was above 0.15%.

Judges can order IIDs for lower BACs in first offenders, but aren’t required to.

Subsequent DWI convictions will result in an order for an IID after the mandatory license suspension ends.

The best way to protect your ability to drive unencumbered is to never be convicted of DWI at all.

Can I Be Convicted Of DWI In New Jersey For Driving After Taking A Legally Prescribed Medicine?

Yes, it is possible to be convicted of DWI in New Jersey if prosecutors can prove that you were intoxicated by a legally prescribed medicine at the time of your arrest.

These are difficult cases to prove, because unlike alcohol arrests, you are not required to provide police with a sample of breath, blood, or urine for chemical testing.

Instead, police rely on a specially trained officer, a Drug Recognition Expert (DRE), who will perform a series of tests to establish whether or not you are intoxicated.

This approach to evidence gathering has many flaws, and defense attorneys have a number of ways to rebut claims made by the DRE.

For instance, a person taking a prescription pain killer to treat a back injury may display many of the physical symptoms of drug intoxication, but the cause is actually the pain itself, not the medicine.

Does New Jersey’s DWI Law Include Driving While Stoned?

Yes, the DWI statute in New Jersey includes a prohibition on operating a motor vehicle while under the influence of illegal drugs and prescription drugs that can cause intoxication.

Unlike a DWI arrest for alcohol, police cannot force you to provide a sample for a chemical test.

If police determine that a blood draw is necessary, they will have to get a court order, but given the fact that marijuana metabolites can remain detectable in blood and urine for weeks after ingestion, these tests provide limited value in proving that you were intoxicated at the time of arrest.

Instead, you’ll be required to submit to a series of tests performed by a specially trained police officer. Results of these tests are subjective, and many police departments don’t have a Drug Recognition Expert available when an arrest is made.

For these reasons, prosecutors have a much harder time proving intoxication in most drug DWI cases, and the defense has many avenues to rebut the charges.
