Do I Have To Notify My College That I Got A DUI If I’m A Student In New Jersey?

March 11, 2016 by Matthew Reisig

New Jersey law does not require that you notify your college of a DUI charge, but your college may have its own policies.Do I Have To Notify My College That I Got A DUI If I’m A Student In New Jersey?

This is particularly worth looking into if you’re an athlete or have certain scholarships, grants, or loans, which may have their own reporting requirements.

One thing to keep in mind when it comes to whether or not to notify is that DWI in New Jersey is not a criminal offense.

If you are asked whether you’ve been charged with or convicted of a crime, the answer in this case is no.

Your New Jersey DWI is not a misdemeanor or a felony, but a traffic offense.

When facing a DUI charge, there is hope.

Reisig Criminal & DWI Law has been defending clients in New Jersey against DUI charges for nearly 30 years, and has helped more than 1,000 drivers avoid conviction.

How Do You Know What A Good DWI Lawyer Is In New Jersey?

March 11, 2016 by Matthew Reisig

Finding a DUI lawyer can be a daunting task. How Do You Find A Good DWI Lawyer In NJ

You’re already emotionally rattled from your experience with law enforcement, and now the internet is giving you hundreds of choices, all claiming to be the best choice for you.

When you strip away the hype and the bombast, the truth is that you’re looking for an attorney who can help you through this and make sure you come out in the best shape possible.

DUI cases are hard to win in New Jersey. The legislature is constantly tightening the rules for DUI and closing loopholes that could help you.

Prosecutors aren’t allowed to negotiate plea bargains in a DUI case, and judges don’t have a tremendous amount of discretion in your sentencing if you’re convicted.

Your lawyer is your best chance at pushing back against all the obstacles ahead of you.

When it comes to hiring a DWI lawyer, look for an experienced attorney who you feel comfortable working with.

Reisig Criminal Defense & DWI Law has nearly 30 years of experience defending DWI cases in New Jersey.

In that time, they have argued DWI law before the New Jersey Supreme Court and helped more than 1,000 drivers avoid conviction on DUI charges.

Is A DUI A Felony In New Jersey? Will I Lose My Right To Vote?

March 4, 2016 by Matthew Reisig

No, DUI is not a felony charge and conviction will not result in a loss of any constitutional rights, though you’ll pay hefty fees and fines and lose your driver’s license for a while.Lose Right To Vote In NJ If Convicted Of DWI

In New Jersey, DUI isn’t even considered a criminal charge, so instead of having a rap sheet, a DUI conviction will appear on your driving abstract.

If you’re a first offender, you may not spend any time in jail, you won’t have a criminal record, and you won’t lose your right to vote or own firearms or lose access to public services.

That said, a DUI conviction poses all sorts of problems. You’ll be paying big surcharges to the state for several years, plus fees and fines, and you won’t be able to drive for months at least.

You’ll have to attend mandatory programs at an Intoxicated Driver Resource Center (IDRC), and your insurance rates will go through the roof, assuming you can keep your policy at all.

You can avoid these problems, but only by beating the charges.

Your best bet to do that is to work with an experienced New Jersey DUI attorney.

Reisig Criminal Defense & DWI Law has helped more than 1,000 New Jersey drivers avoid conviction on DUI charges.

Is Jail time Automatic With A New Jersey DWI?

March 4, 2016 by Matthew Reisig

Getting arrested for a DWI (driving while intoxicated) in New Jersey can be a scary and overwhelming experience. You’re probably wondering what happens next—especially when it comes to the possibility of going to jail. The truth is, jail time can be a consequence, but it’s not always automatic, especially if it’s your first offense. Is Jail Time Automatic For A DWI in New Jersey

Under New Jersey law, if you’re convicted of a first-time DWI, you could face up to 30 days in jail. However, in many cases, judges are more likely to order you to attend classes at an Intoxicated Driver Resource Center (IDRC) instead of sending you to jail. These IDRC sessions are designed to educate drivers about the dangers of impaired driving and help prevent future offenses.

That said, every case is different. A lot depends on the circumstances of your arrest. If there were aggravating factors—like driving at extremely high speeds, being involved in an accident, or acting aggressively toward law enforcement—the judge might take a tougher approach. Even on a first offense, behavior that’s considered especially reckless or dangerous could lead to harsher penalties, including time behind bars.

This is why having a skilled attorney on your side can make all the difference.

Trying to handle a DWI charge on your own is risky. The legal system is complicated, and mistakes can be costly. Whether you’re completely new to the court system or you’ve dealt with legal issues before, a knowledgeable DWI attorney can help you understand your options and fight for the best possible outcome in your case.

That’s where Reisig Criminal Defense & DWI Law comes in.

Do I Need To Worry About The Other Tickets I Got In My DUI Stop In New Jersey?

February 24, 2016 by Matthew Reisig

Your DUI attorney will make sure that all other tickets that were issued in a DUI stop in New Jersey are addressed.

Sometimes fighting the other tickets can change the outcome of your case, as something like failure to maintain lane will serve as probable cause for the police to investigate you for driving drunk.

If there is video evidence or eyewitness accounts that challenge the case against you, you need an attorney who will attack the charges head on.

Matthew Reisig is one of New Jersey’s most experienced DUI attorneys, who has argued DUI law in front of the Supreme Court of New Jersey and helped more than 1,000 New Jersey drivers avoid conviction on DUI charges.

Can I Move My Court Date For My New Jersey DUI?

February 24, 2016 by Matthew Reisig

It’s possible to change a court date for a DUI in New Jersey, but it’s not a given.

Typically, the court will consider a change to its calendar only in limited circumstances, like a serious conflict such as scheduled surgery, or a need for more time to build your case.

Don’t expect the judge to just grant your request.

An experienced New Jersey DUI attorney can make sure that your case proceeds in the best way for you, and that your needs get full consideration from the court.

Matthew Reisig has helped more than 1,000 New Jersey drivers avoid conviction on DUI charges, by carefully shepherding their cases through the legal process.

When you need extra time to make the strongest case possible, call 732-625-9660 for a free consultation with an experienced New Jersey DUI attorney.
