How Long Will I Lose My License For DUI In New Jersey If I’m Under 21?

People who are under the legal drinking age and are caught driving with a blood alcohol content of just .01% or higher are subject to a variety of DUI penalties in New Jersey.

First, a conviction means that you’ll lose your license for 30-90 days, as well as face a 15-30 day period of community service.

There are also mandatory fines to pay, and completion of alcohol and highway safety courses at one of the state’s Intoxicated Driver Resource Center (IDRC).

I Don’t Think The Police Had Probable Cause To Stop Me. Is That Grounds To Fight A DUI In New Jersey?

Yes it is. An illegal traffic stop, that is, when police have stopped you and subjected you to interrogation without probable cause to do so, is grounds to fight and possibly quash any charge against you that stems from the stop.

Under the law, evidence gained from an illegal stop, like statements, field sobriety tests, or even Alcotest results, is not admissible in a court proceeding.

Police conduct is highly regulated and governed by long standing rules and norms, and violations of those rules and norms will damage any case the police try to build.

The problem with arguing probable cause when you’ve ultimately been charged with an offense is that the police and prosecutor will argue that the charge itself demonstrates the validity of whatever rationale, possibly developed after the fact, of the initial stop.

Are Penalties Lower If You’ve Been Charged With DWI In New Jersey With A BAC Of Less Than .08%?

No, while there are penalty enhancements when a driver’s BAC was above .10%, drivers who have been charged with DWI in New Jersey but whose Alcotest results were lower than the legal limit are not entitled to any potential sentence reductions.

If a cop felt that you were displayed evidence of intoxication, you can be charged with DWI even with a blood alcohol concentration far below .08%.

For drivers under 21, the level that is considered legal evidence of intoxication is .01%.

If My BAC Was Under .08%, Do I Have A Strong Case In My New Jersey DWI?

A blood alcohol concentration below .08% won’t prevent you from being prosecuted for DWI in New Jersey, but it does give you a stronger case to rebut the allegation that you were driving while intoxicated.

Most people don’t realize that there are two types of DWI cases in New Jersey.

In the first, your breath or blood will be tested for alcohol, and a result higher than the statutory limit of .08% is considered proof of intoxication.

In the second type of DWI prosecution, you can be convicted even if your BAC result was below the statutory limit, or wasn’t recorded at all.

Based on the observations of police and any other evidence available, the state can allege that you displayed indications of intoxication while operating a vehicle, and prosecute you that way.
