How Long Will A Past DWI Conviction Count Towards My Current DWI Case In New Jersey?

In New Jersey, a past DWI conviction can significantly impact any future DWI charges you face. New Jersey has a “step-down” provision that dictates how long a prior conviction counts toward your current DWI case.What Impact Does A DWI In The Past Have On A Current Arrest

This provision allows for less severe penalties if a long enough period has passed since your last conviction. Specifically, if more than 10 years have gone by between your first and second DWI offense, the second offense may be treated as a first offense when it comes to penalties. However, if less than 10 years have passed, your prior conviction will still count, and you’ll face enhanced penalties.

The “step-down” rule applies to both second and third offenses. For example, if you had a second DWI conviction more than 10 years after your first, your third conviction could be treated as a second offense if another 10 years has passed. What Happens If My BAC Was Over .10% In A New Jersey DUI Stop?

When you’ve been arrested for DUI in New Jersey with a BAC reading over .10%, you’re facing a stricter set of penalties than traditional DUI with a .08-.10% BAC.

Instead of a three month license suspension, you’ll lose your license for up to a year, and at least seven months.

If your BAC was over .15%, you’ll also be required to install an Ignition Interlock Device on your car for six months to one year after you get your license back.

You can also be sentenced to up to 30 days in jail and you’ll face hundreds of dollars in fees and fines and thousands of dollars in DMV surcharges.

What Are The Penalties If My License Was Suspended When I Was Stopped For DWI In New Jersey?

As a base proposition, you’ll face additional fines of $500, up to two years additional license suspension, and a jail sentence of 10 to 90 days.

However, if your license was suspended because of a second (or third, or fourth) DWI conviction, you’re looking at much more serious circumstances.

Instead of traffic offenses, your charges will be indictable offenses, which most states classify as ‘felonies’, and you’ll face a six month mandatory jail sentence if convicted.
