I Had A DUI In New Jersey Years Ago. What Kind Of Trouble Am I In For A Second DUI?

September 27, 2015 by Matthew Reisig

How your DUI will be charged depends on several things. First, how long ago was your previous conviction?

If it was within a ten-year window, you’ll be charged with DUI as a second offense, which results in harsher penalties.

For instance, instead of a possible sentence of 30 days, the judge can sentence you to up to 90 days in jail.

Your license, which was suspended for three to 12 months the first time around, can now be suspended for a full two years.

You don’t have to be convicted of DUI in New Jersey, even if you’ve been convicted before.

Attorney Matthew Reisig has helped more than 1,000 drivers in New Jersey avoid conviction on DUI, and he can help you even if you’ve been down this road before.

How Can I Avoid Being Charged With DUI As A Second Offense In New Jersey? I Pled Guilty To DUI Three Years Ago.

September 27, 2015 by Matthew Reisig

Generally, a DUI conviction from three years ago will mean that a subsequent DUI will be charged as a second offense, but not always.

Because you pled guilty, you may have grounds to revisit the case using a process known as an application for post-conviction relief.

With an application for post-conviction relief, you can assert that there were flaws in your original case and challenge the previous conviction.

This can result in your current DUI case being charged as a first offense rather than a second offense, saving you from increased penalties including up to 90 days in jail and a license suspension of two years.

Applications for post-conviction relief are not easy to win, but when strategizing for success in any DUI case, it should always be considered when there are previous convictions in play.

Attorney Matthew Reisig has helped more than 1,000 New Jersey drivers avoid conviction for DUI, and can help you prepare the strongest possible defense in your DUI case.

Can You Help Me Get My CDL Back If I’ve Been Convicted Of DWI In New Jersey?

September 17, 2015 by Matthew Reisig

If you’re a commercial driver who has been convicted of DUI in New Jersey, you’re facing a mandatory one-year loss of your CDL.

If you’ve had prior convictions, your CDL will be gone for good.

Those are the penalties in New Jersey, but the good news is that there may be ways to challenge the facts of your case even after a conviction.

By using an application for post-conviction relief, it may be possible to assert flaws in the original case, violations of your rights, or to attack the conviction on the basis of ineffective counsel.

Whatever the grounds, if the application for PCR is successful, the court may be forced to vacate the conviction entirely, leaving your CDL intact.

Judges are not eager to have old cases re-opened, but in the interest of justice, such petitions are legal and can be quite effective.

You should consult with an experienced DUI and post-conviction relief attorney before attempting to overturn your conviction.

Attorney Matthew Reisig has almost two decades of experience helping New Jersey drivers retain and regain their licenses after a DUI.

What Happens To Truckers Who Are Convicted Of DUI In New Jersey?

September 10, 2015 by Matthew Reisig

When a commercial driver is facing DUI charges, one of the biggest unknowns they face is whether they’ll be able to continue working in their field.

Unfortunately, if you’re convicted of DUI as a commercial driver, you’ll be disqualified from commercial driving for up to a year.

If the cargo you were hauling was hazardous, the disqualification runs to three years.

And these penalties can be applied even if your blood alcohol level is half that of an ordinary driver – 0.04% is all that’s required to cost you your career.

Generally, commercial drivers find it extremely difficult to get work in their field after a DUI conviction.

Trucking operations consider the liability risk to be too high to work with people with a record of driving drunk.

If you’re a commercial driver in New Jersey facing DUI charges, there is hope.

Attorney Matthew Reisig has helped more than 1,000 New Jersey drivers avoid conviction on DUI charges.

What Is The Legal Blood Alcohol Limit For Truckers Driving Through New Jersey?

September 10, 2015 by Matthew Reisig

Commercial drivers in New Jersey are subject to different rules than others when it comes to DWI/DUI.

Most significantly, truckers are in violation of the law if their blood alcohol level is above .04%, or half the traditional legal limit for non-commercial drivers.

Second, the types of punishments available to a trucker are a little different as well.

If your cargo is non-hazardous, you may face a one-year exclusion from driving commercially.

If you’re hauling hazardous cargo and are stopped for DUI, you may face a three-year bar on working in your field.

Practically speaking, if you’re convicted of DWI as a commercial truck driver, it’s likely you’ll have a very hard time being hired by companies in your industry.

Attorney Matthew Reisig has helped more than 1,000 New Jersey drivers avoid conviction on DUI charges.
