In New Jersey, How Do I Get My Driving Privileges Restored After A DWI?

Once you’ve completed the penalties the court sentenced you to after your DWI conviction – which may include jail time, license suspension, community service, DWI classes, and the payment of fines and restitution – you still have a couple more steps before your can legally operate a motor vehicle in New Jersey again.

You’re required to pay a $100 restoration fee to the Motor Vehicle Commission, which will mail you a Notice of Restoration.

Once you have that, you’ll visit your local MVC with the Notice of Restoration, proof of insurance, and proper identification to have your license reinstated.

Why Wasn’t I Given A Miranda Warning When I Was Pulled Over For DWI In New Jersey?

The police are not required to give you a Miranda warning when they pull you over, or even necessarily when they handcuff you and drive you to the station.

A good lawyer will often be able to quash statements you may have made to the arresting officer as long as you haven’t been informed of your right to remain silent, and that any statements you make will be used against you.

It would certainly be convenient if beating a DWI was as simple as arguing that the arresting officer didn’t read you your rights prior to asking you to perform a sobriety test, but unfortunately it doesn’t work that way.

How Can I Expunge My DWI In New Jersey?

New Jersey doesn’t allow expungement of DWI convictions, but luckily, New Jersey also doesn’t treat it as a criminal matter that appears on criminal background checks.

This means that when you apply for an apartment, a home mortgage, or a new job, odds are good that your DWI will be completely invisible to a check.

Will The NJ Judge Go Easy On Me If I Plead Guilty Instead Of Fighting A DWI?

It’s certainly possible that if your DWI was routine and no one was injured, there were no children involved, your BAC was under .10, and there were no additional charges for things like reckless driving, that the judge will err on the low end of New Jersey’s mandatory sentencing for DWI if you plead guilty.

This means you’re looking at the lower end of jail time, fines, license suspension, and other penalties, which is preferable to the high end of those penalties, but you’ll still have to face years of increased insurance costs and other problems as a result of the conviction.

You have a right to representation and you have a right to your day in court.

Being charged with a DWI in New Jersey is not the same as being convicted.

Will I Lose My License In My Home State If I Got A DWI While Visiting New Jersey?

The answer to that varies across the states. New Jersey will notify your home state, but what happens from there is up to their laws.

Some states will suspend your license until New Jersey’s period of suspension is over, while others won’t apply any penalties.

One element that out of state residents sometimes benefit from when they get a DWI in New Jersey is that the charge isn’t considered criminal in nature here.

Many states just don’t have the resources to enforce out of state traffic violations, though DUI/DWI may be a misdemeanor or even a felony when it happens in that state.
