How Can I Defend Myself If I Blew Over The Limit In New Jersey?

As much as the police and prosecutors would like for you to decide that the evidence they have against you is airtight and that there’s nothing you can do to fight back, the truth is that a breath test reading over 0.08% isn’t the silver bullet they want you to believe it is.

There are many defenses against a DUI in New Jersey, and the only way to properly develop a strategy is to examine the particulars of your case.

For starters, we’ll begin by asking what was the probable cause for pulling you over.

In the field, police will often initiate a traffic stop based on a hunch rather than witnessing a violation of traffic laws. If you broke no laws, there was no probable cause.

We’ll ask to see any videos the police cruiser may have recorded, which can also tell us important information about any field sobriety test you may have been asked to take.

In New Jersey, What’s The Difference Between The Breathalyzer And Alcotest?

For many years, the Breathalyzer device was considered the standard breath analysis machine by law enforcement in New Jersey and many other states.

While it did provide data to the police and prosecutors, the Breathalyzer had many flaws that could be exploited by the defense in DUI cases.

In recent years, New Jersey has adopted the Alcotest device and stopped using the Breathalyzer entirely.

The Alcotest is considered more reliable by the courts, because it is more automated and less subject to operator manipulation. However, there are still numerous defenses to an Alcotest result, and operators are still required to follow strict protocols in its use, which they often fail to do.

Don’t The Police Need My Consent To Draw Blood In New Jersey If They Suspect Intoxication?

Yes, for police to withdraw blood for testing, they need either your consent or a warrant from a New Jersey judge.

Drivers in New Jersey are subject to “implied consent” when it comes to breath testing, and if you refuse a breath test, you will be charged with refusal and face similar penalties to a DWI itself.

If you decline the breath test, police may try to coerce you into providing a blood sample, but absent a warrant, they can’t force you to give one.

The consent situation is different in cases where you may have been in an accident and been transported to the hospital.

Blood will likely be drawn as a medical necessity, and the results of that testing can be subpoenaed by prosecutors.

You can be arrested for DWI at the hospital, even if you are not medically stable enough to be transported.

Can A License Suspension Be Shortened In A DWI Conviction In NJ?

No, upon conviction for DWI in New Jersey, your license will be suspended for the period ordered by the judge.

You’ll be required to attend counseling, educational classes, or even substance abuse treatment as part of the Intoxicated Driver Program, and a failure to successfully complete prescribed programs can result in a recommendation to the MVC that your license remain suspended even longer.

How Many Times Can An Officer Insist On A Field Sobriety Test In New Jersey?

Police may try to get you to perform three types of standardized Field Sobriety Tests (FSTs), and even ask you additional questions that amount to non-standardized FST.How Many Times Can A NJ Cop Ask Me To Do Field Sobriety Test

In some cases, police appear to use the FST process in an abusive way, where you successfully complete a round of tests and the officer insists you do them again, until eventually you fail and are arrested.

From a defense perspective, this behavior may give us grounds to argue that the arrest was inappropriate.

While refusing a Field Sobriety Test isn’t the same as refusing a chemical test in New Jersey, you will almost certainly be arrested if you refuse the FST.

How you choose to proceed from the time of arrest will have a big impact on your ability to drive in the near term.

You should strongly consider consenting to chemical testing and fighting any adverse finding in court, as you can be convicted of Refusal for declining tests, and you can be convicted of DWI even without FSTs or chemical testing.

What Happens At The Intoxicated Driver Resource Center In New Jersey?

As part of your DUI/DWI sentence, you’ll have to report to the IDRC in your county for evaluation over a given period of time.

While there, you’ll meet with a counselor, fill out forms, and attend educational sessions. IDRC will determine what additional interventions may be necessary, from in-patient substance abuse treatment to self-help programs and groups.

And of course, you’ll pay the IDRC for their help.

How long you’ll be at the IDRC depends on whether this is your first conviction for drunk driving. First offenders should expect at least 12 hours in the IDRC served over a couple of days, while second offenders are detained for 48 hours in regional IDRC centers for more intensive evaluation.
