Do You Represent Underage Drivers With DWIs In New Jersey?

Yes, I have extensive experience representing underage drivers who’ve been charged with DUI/DWI in New Jersey.

The rules for drivers who are under 21 are different, as are the potential punishments if you are convicted.

First, while most New Jersey drivers need to blow .08% or higher on an Alcotest device to be convicted, a driver who isn’t old enough to drink can be convicted if their sample is as low as .01%.

Any alcohol in the system of a driver under the age of 21 is considered evidence of intoxication, which may or may not be accurate.

There are a number of defenses to explore in any DUI/DWI case in New Jersey, and because the thresholds are so low for underage drivers, the chance of machine error or even a medical problem or drug interaction producing a “false positive” can’t be ruled out.

Every case brings its own unique facts to be worked through, but I have helped more than 1,000 New Jersey drivers avoid conviction on DUI charges.

New Jersey has an extremely strict DUI law when it comes to underage drinking and driving.

When an underage driver is stopped for DUI, the rules that apply to over-21 drivers in New Jersey aren’t in effect.

According to N.J.S.A. 39:4-50.14,drivers who are not old enough to legally purchase alcohol can be charged and convicted of DUI if their blood alcohol content is as low as 0.01%.

Aside from the DUI charge, you can also be charged with underage alcohol possession under N.J.S.A. 2C:33-15, and other alcohol offenses.

Penalties on the DUI charge include a 30-90 day suspension of your driver’s license, 15-30 days of community service, participation in the state’s Intoxicated Driver Resource Center (IDRC) program, and mandatory fines and penalties.

The best solution to any DUI charge is to avoid conviction altogether.

What Are The Penalties For DWI For A 19-year-old In New Jersey?

For drivers who aren’t yet 21, New Jersey’s DWI statute casts a much wider net than it does for drivers of legal drinking age.

As a 19-year-old, a blood alcohol reading of between .01 – .79 is enough to get you charged with underage DWI.

At this level, your license can be suspended for as long as 90 days, you can face up to a month of community service, and you’ll be detained by the IRDC, with all the attendant fines and fees that go with it.

Underage drivers who blow .08 or higher are looking at a 30 day jail sentence, and a license suspension that can go as long as 12 months, depending on the recorded BAC.

In addition, you’ll be staying at IRDC for 24-48 hours and facing thousands of dollars in fines and surcharges.

What Is Underage DWI In New Jersey?

NJSA 39:4-50.14 is entitled operation of motor vehicle by person who has consumed alcohol but is under the legal age to purchase alcoholic beverages.

Therefore, it pertains to a Blood Alcohol Content of at least .01%, but less than .08%. The license suspension is from 30-90 days, and there is community service for 15-30 days. Also, there is an Intoxicated Driver Resource Center requirement. There is no fine, and it is not considered a DWI.
