How Can Police Prove I Was High On Pot When I Was Arrested For DUID In New Jersey?

In cases where police suspect a driver was driving while under the influence of drugs (DUID) in New Jersey, prosecutors will have a significantly harder time proving the allegation than they would in a standard, alcohol-based DUI/DWI prosecution.How Do Police Prove You're Under The Influence for a DUID Charge

First, police must show evidence that you were “under the influence” of marijuana.

This may include observations of redness of eyes, pupil dilation, results of a field sobriety test, and other eyewitness statements from police.

If you provide a urine or blood sample, that evidence may be entered as well.

Can I Be Charged With DUI In New Jersey For Having An Open Bottle Of Beer In My Car?

While possession of an open container of alcohol in your car (NJSA 39:4-51b) is illegal, it is not in itself sufficient to charge you with DUI in New Jersey.

But you can bet that you’ll be in for a serious encounter with police that may include a request to perform Field Sobriety Tests – which you can decline without penalty – and the possibility of being taken into custody to provide a breath sample.

Police have wide latitude if they believe you are demonstrating signs of intoxication, and if you’re caught with an open container in your car, they’ll be looking at you very closely.

You can be charged and convicted of DUI in New Jersey even if your Alcotest (breath test) results are below the legal threshold of .08.

If police believe you are showing signs of impairment, you can be convicted based on their observations of your behavior.

Is It Illegal To Drive With An Open Container Of Alcohol In The Car In New Jersey?

Yes, under New Jersey law, it is illegal to drive while in possession of an open container of alcohol in your passenger compartment (NJSA 39:4-51b).

This includes open bottles as well as alcoholic drinks that may have been poured into a cup.

Open containers of alcohol that are stored in your car’s trunk, or behind the last upright seat in a trunkless vehicle, are not violations of the open container law.

Mobile homes, limousines, and chartered buses are also subject to exemption in most cases.

The penalty for driving with an open container is a $200 fine on the first offense, with a $250 fine and 10 days of community service for a second and subsequent offense.
Alcohol
This may not seem like a big deal to you, but keep in mind that if you’re the sort who is likely to run into alcohol violations in New Jersey, a history of offenses like this can lead to much more significant exposure down the road.
