Is There Any Hope Of Winning A DUI Case In New Jersey When I’ve Had Two Previous Convictions?

April 9, 2015 by Matthew Reisig

Yes, every DUI case in New Jersey can be defended, even if you’ve had past convictions.

Because police run your license plate number and then your drivers license when you’re stopped, they can be “primed” to look for signs of intoxication, even if none are apparent.

People can be charged with DUI even if they don’t blow a .08% on the Alcotest device, based solely on the observations of the police officer who detained you.

Any defense appropriate for a DUI without past convictions may still be appropriate for you.

Your past convictions may make the case more difficult, or may create additional opportunities for a strong defense.

Attorney Matthew Reisig has helped more than 1,000 drivers in New Jersey beat a DUI charge.

Matthew Reisig has helped more than 1,000 New Jersey drivers avoid conviction on DUI charges, and has argued before the New Jersey State Supreme Court regarding flaws in New Jersey’s Alcotest device.

What’s The Blood Alcohol Limit For Underage Drivers In New Jersey?

March 27, 2015 by Matthew Reisig

New Jersey has an extremely strict DUI law when it comes to underage drinking and driving.

Drivers who are not yet 21 and have a blood alcohol content of 0.01% are technically in violation of N.J.S.A. 39:4-50.14, Operation by Person Who Has Consumed Alcohol Who Is Below Age To Purchase Alcoholic Beverages.Reisig DWI & Criminal Defense Law

In addition, the statute makes clear that any DUI penalties stemming from conviction can be levied in addition to other charges, like underage alcohol possession or underage drinking.

Teenagers who drink and drive run the risk of considerable consequences, including suspension of their license, fines, and a permanent black mark on their driving abstract that will make auto insurance expensive or unavailable.

These outcomes can be avoided, call attorney Matthew Reisig today at 732-625-9660 for a free consultation with an experienced New Jersey DUI defense lawyer.

What Happens To Drivers Who Are Under 21 When They Get A DUI In New Jersey?

March 27, 2015 by Matthew Reisig

When an underage driver is stopped for DUI, the rules that apply to over-21 drivers in New Jersey aren’t in effect.

According to N.J.S.A. 39:4-50.14,drivers who are not old enough to legally purchase alcohol can be charged and convicted of DUI if their blood alcohol content is as low as 0.01%.

Aside from the DUI charge, you can also be charged with underage alcohol possession under N.J.S.A. 2C:33-15, and other alcohol offenses.

Penalties on the DUI charge include a 30-90 day suspension of your driver’s license, 15-30 days of community service, participation in the state’s Intoxicated Driver Resource Center (IDRC) program, and mandatory fines and penalties.

The best solution to any DUI charge is to avoid conviction altogether.

Matthew Reisig has helped more than 1,000 New Jersey drivers beat DUI charges.
