Can I Really Defend Myself In Court If I Blew Over .08% On The Alcotest In New Jersey?

April 30, 2015 by Matthew Reisig

In almost every New Jersey DUI case, there are valid avenues of defense, even if you blew above a .08% on the police’s Alcotest device.

The important thing to consider when you’ve been charged with DUI is how willing you are to contest the matter, and how seriously you want to win.

When the evidence is against you but you still believe you’re being wrongfully prosecuted, you have to work with an experienced New Jersey DUI attorney to fight back.

Not only will your lawyer help you avoid legal pitfalls and make sure you’re fully informed about all aspects of your case, but many bring years or decades of highly specialized experience on board.

Matthew Reisig has gone before the Supreme Court of New Jersey and argued technical aspects of DUI law, especially as they relate to the Alcotest.

You’re unlikely to find a more experienced and knowledgeable attorney when it comes to challenging Alcotest results in New Jersey DUI cases.

Can I Move Out Of New Jersey And Get A Driver’s License After A DUI Conviction?

April 30, 2015 by Matthew Reisig

In general, the answer is no.

Most states have signed a compact in which they agree to share information about DUI convictions, so a New Jersey resident can’t hop across the border and get an apartment in New York or Pennsylvania and wait out their license suspension.

Neither state, like nearly all other US states, will allow you to get a license if you’re facing a New Jersey suspension or revocation.

Your best bet if you’ve been charged with DUI in New Jersey is to work with an experienced DUI attorney who can shield you from the worst consequences of a DUI conviction – like a long license suspension.

Attorney Matthew Reisig has helped more than 1,000 New Jersey drivers avoid conviction on DUI charges, and he can make a big difference in your DUI case.

Are Field Sobriety Tests In New Jersey Definitive In A DUI Case?

April 23, 2015 by Matthew Reisig

No, Field Sobriety Tests are not definitive evidence in a New Jersey DUI case, and in many cases may not be admissible at all.

An experienced New Jersey DUI attorney can tell the difference between authorized Field Sobriety Tests (FSTs) and non-standard ones that police may sometimes use to throw an unsuspecting driver off.

A strong attorney can also raise questions about the level of training a police officer may have received and whether they were qualified to administer and evaluate FSTs in the first place.

It isn’t easy to beat a DUI charge in New Jersey, but when the main evidence is the observational testimony of a police officer, an experienced DUI attorney may be able to call those observations into question, or have the evidence thrown out entirely.

Attorney Matthew Reisig has helped more than 1,000 New Jersey drivers avoid conviction on DUI charges, and can make a difference in your case.

Are Alcotest Results In New Jersey Definitive In A DUI Case?

April 23, 2015 by Matthew Reisig

Alcotest results can be very persuasive in a New Jersey DUI case, but they don’t have to be definitive.

There are a number of ways to attack Alcotest results, including questioning the certifications of the Alcotest operator, offering medical evidence that suggests your body may not provide normal readings, and even questioning the original stop that led to you being taken into custody and having the test administered.

The problem is that while Alcotest results may be challenged, prosecutors can use other evidence, including observations and even video evidence offered by the police.

This is why it’s vital that you work with the most experienced New Jersey DUI attorney you can find.

By questioning all the evidence and pushing back against weak cases, Matthew Reisig has helped more than 1,000 New Jersey drivers avoid conviction on DUI charges.

I Got A DUI In New Jersey Almost A Year Ago And No Court Date Has Ever Been Scheduled. Is This Grounds For Dismissal?

April 16, 2015 by Matthew Reisig

Experienced DUI Lawyer In New Jersey

A delay of almost a year in a DUI case in New Jersey may be grounds for dismissal.

New Jersey requires that DUI cases must be filed and served within 90 days, but you may also have grounds to fight on your constitutional right to a speedy trial.

While there’s no set length of time that governs a speedy trial motion, the court will review the facts of your case and the reason for the delay to determine whether your case should be dismissed.

An experienced New Jersey DUI attorney can begin this process for you.

First, we have to determine that actions haven’t been taken against you that you were somehow not informed of.

If you missed court dates, there may be outstanding warrants and other problems that will have to be addressed first.

Matthew Reisig has helped more than 1,000 New Jersey drivers avoid conviction on DUI and has argued DUI law before the New Jersey State Supreme Court.

Can I Get A DUI In New Jersey If I Was In A Parked Car?

April 16, 2015 by Matthew Reisig

New Jersey Attorney For Those Charged With DUI

Yes, you can be charged with DUI in New Jersey if you were in your parked car at the time you were taken into custody.

In cases like this, the prosecutor will have to persuasively show that you intended to operate the vehicle while drunk, which opens a number of opportunities for your defense team to push back against the charge.

New Jersey has some of the toughest DUI laws in America, and conviction can leave you off the road for months or even years.

When you work with an experienced New Jersey DUI attorney, you stand the best chance of avoiding the worst penalties that the court can hand down.

Matthew Reisig has helped more than 1,000 New Jersey drivers avoid conviction on DUI charges.
