Do You Represent Underage Drivers With DWIs In New Jersey?

June 12, 2015 by Matthew Reisig

Yes, I have extensive experience representing underage drivers who’ve been charged with DUI/DWI in New Jersey.

The rules for drivers who are under 21 are different, as are the potential punishments if you are convicted.

First, while most New Jersey drivers need to blow .08% or higher on an Alcotest device to be convicted, a driver who isn’t old enough to drink can be convicted if their sample is as low as .01%.

Any alcohol in the system of a driver under the age of 21 is considered evidence of intoxication, which may or may not be accurate.

There are a number of defenses to explore in any DUI/DWI case in New Jersey, and because the thresholds are so low for underage drivers, the chance of machine error or even a medical problem or drug interaction producing a “false positive” can’t be ruled out.

Every case brings its own unique facts to be worked through, but I have helped more than 1,000 New Jersey drivers avoid conviction on DUI charges.

Call attorney Matthew Reisig today at 732-625-9660 for a free consultation with an experienced New Jersey DWI/DUI attorney.

Fighting a DUID Charge with Marijuana in New Jersey

June 12, 2015 by Matthew Reisig

Facing a Driving Under the Influence of Drugs (DUID) charge in New Jersey can be a daunting experience. When marijuana is involved, the situation can become even more complex. On this page, we want to provide guidance on how to navigate a DUID charge related to marijuana in Monmouth County, Ocean County, and Middlesex County, New Jersey. We’ll explore the challenges you may encounter and how an experienced attorney like Matthew Reisig can help you build a solid defense.DUID And Marihuana Possession Arrest

Understanding the Challenges Of A DUID Arrest

In New Jersey, the presence of marijuana during a traffic stop can lead to a series of challenges if you’re accused of driving under the influence. Law enforcement officers employ subjective tests to establish signs of intoxication, making it crucial to understand how to challenge their evidence.

Subjective DUID Tests

When you are pulled over and found with marijuana, police may use various subjective tests to prove that you were intoxicated. If you were pulled over for weaving between lanes or driving too slowly, these allegations will be brought up in court as indicators of impairment. It’s important to note that these tests can be subjective and open to interpretation.

Smell of Marijuana

If you or your vehicle smelled of marijuana during the traffic stop, this could be used as evidence against you. The presence of marijuana smoke in your car is also likely to be presented in court. This emphasizes the importance of understanding your rights during a traffic stop and how to handle such situations.

Physical Signs of Intoxication

Physical signs such as red eyes, slurred speech, stumbling, or motor control issues may be alleged by the police officer as evidence of impairment. These observations can be highly subjective and may not necessarily prove that you were under the influence of marijuana while driving.

Building a Strong DUID Defense in NJ

The key to fighting a DUID charge in New Jersey is to challenge the evidence presented by the police and prosecutors effectively. A skilled defense attorney like Matthew Reisig can help you navigate this process.

Initial Stop For DUID

Your attorney will examine the circumstances surrounding the initial traffic stop. They will evaluate whether the stop was conducted legally and if your rights were respected throughout the encounter. Any violations of your rights can be grounds for suppressing evidence in court.

Search and Seizure

If a search of your vehicle was conducted, your attorney will scrutinize whether it was conducted lawfully. Unlawful searches and seizures can result in the exclusion of evidence obtained during the search, weakening the prosecution’s case.

Testimony of the Arresting Officer

Your attorney will carefully review the testimony of the arresting officer, looking for inconsistencies or inaccuracies. Challenging the credibility of the officer’s observations and conclusions can be a crucial aspect of your defense.

Facing a DUID charge in New Jersey when marijuana is involved can be challenging, but it’s not impossible to build a strong defense. Understanding the subjective nature of the evidence presented against you and having an experienced attorney like Matthew Reisig by your side can make a significant difference in the outcome of your case.

Can My New Jersey DUI Case Be Postponed While I Complete An In-Patient Substance Abuse Program?

June 4, 2015 by Matthew Reisig

Judges in New Jersey tend to look favorably on defendants who take significant steps to remedy the behaviors that have brought them into court in the first place.

If you’ve decided to attend an in-patient rehabilitation program that will conflict with your DUI court date, it may be possible to ask the judge for a postponement to give you the best chance at successfully completing the program.

The specific facts of your case will matter in how the judge decides, but remember: If you have a substance abuse problem, getting help can make a huge difference to your future, the DUI charges notwithstanding.

Prioritize your health, and let attorney Matthew Reisig take care of the legal issues while you focus on the things that matter.

Does It Help My DUI Case In New Jersey If I Begin Attending Substance Abuse Counseling?

June 4, 2015 by Matthew Reisig

Approaching a DUI in New Jersey as a serious event that suggests significant lifestyle changes may be necessary is a mature and rational way to make a bad situation into something positive.

While participation in substance abuse counseling will not, by itself, cause a judge to let you off the hook, judges tend to take a more favorable approach in DUI cases when the defendant is taking steps to learn from past mistakes and make sure they don’t happen again.

How you choose to understand the meaning of your DUI is something you and your loved ones should discuss in detail.

If you need help connecting to counselors or substance abuse programs, my office can provide you with resources.

I can also help ensure that your efforts to face a substance abuse problem head on is noted by the court and given full weight in the case against you.

For a DUI defense that puts you first, call 732-625-9660 today for a free consultation.

Can You Help Me Get My New Jersey DUI Case Heard By A Jury Instead Of Just A Judge?

May 28, 2015 by Matthew Reisig

DUI cases in New Jersey are heard by municipal court judges, not in jury trials.

This is because a DUI charge is not a criminal charge, per se, but is instead considered a traffic violation, so there is no entitlement to a trial by jury in these cases.

There are instances where a defendant has a history with a judge and you may have concerns about the judge’s ability to be impartial in your case.

If there is a genuine conflict, it is possible to notify the court of your concerns and ask the judge to recuse him or herself, though there are risks with this approach.

The best way to develop a sound defense strategy is to work with an experienced New Jersey DUI defense lawyer who can ensure that your rights are protected from your first appearance to your DUI trial.

Attorney Matthew Reisig has almost 20 years of experience fighting DUI charges in New Jersey, and has successfully defended more than 1,000 clients against DUI charges in the state.

Can You Help Me Plea Bargain My DUI To A Lesser Charge In New Jersey?

May 28, 2015 by Matthew Reisig

No, unfortunately, New Jersey prosecutors do not have discretion to plea bargain in DUI cases, so if you’ve been charged with DUI, it’s because prosecutors believe they can prove that charge instead of a lesser one.

So while you’re not going to have much luck trying to bargain with prosecutors, you do have options.

Contrary to popular opinion, every DUI case in New Jersey can be challenged, and every DUI defendant has the right to present a strong case in their own defense.

The best way to achieve a positive outcome is to work with an experienced DUI attorney who understands the complexity of New Jersey DUI law and has the track record and resources to treat your case with the seriousness it deserves.

Attorney Matthew Reisig has helped more than 1,000 New Jersey drivers avoid conviction on DUI charges, and has argued technical aspects of DUI law before the New Jersey State Supreme Court.
