Young Driver Crashes Car into Apartment, Faces DWI Charge in New Jersey

A DWI is problem enough for anyone, but for drivers who are under 21 and charged with drunk driving, a conviction can result in a black mark on your record that can make auto insurance unaffordable or even unavailable to you for years to come.

For a young Yardville, NJ, driver, the expenses from his recent drunk driving charge may be higher still.

Police say that Thomas Walters, 20, was driving while intoxicated around 3:15 in the morning on Monday, September 5, when his car crashed through a wooden fence at Glassboro’s Campus Crossings Apartments and ended up in the living room of one of the apartments, causing substantial damage.

Fortunately, no one was in the unit at the time, but Walters and his 19-year-old passenger fled the scene on foot, returning a short time later, where they were arrested.

If convicted, Walters will face the normal consequences of a DWI, including license suspension and fines, but will also likely have to pay to cover the damage to the apartment building his vehicle struck.

“Intent to Operate” is Significant Element in New Jersey Parked-Car DWI Cases

People have even been arrested for DWI in New Jersey after they arrived at their destination, exited the vehicle, and sat down at a diner counter to eat.

It may seem strange, but it’s extremely risky to try to “sleep it off” in your parked vehicle, a legal situation that Assemblyman John McKeon says that the legislature should revisit.

A 43-year-old DWI case highlights the potential for inconsistent application.

In State v. John Daly, a man was drinking at a bar in the winter. He left the bar drunk, went to his car, and turned the ignition on so the heater would work, then he went to sleep.

He was arrested for DWI, and went to court arguing that his intention was to sleep without getting frostbite, not to “operate” his vehicle.

The court agreed with him, and ever since, there has been a risk of inconsistent enforcement of DWI laws.

Whether new law is made around this point remains to be seen, but the takeaway for New Jersey drivers is that there are defenses to DWI, especially when you weren’t operating your vehicle at the time of your interaction with police.

New Jersey Man Arrested for DWI After Ramming Police Car

A 54-year-old Point Pleasant man has been arrested on a host of charges after a bizarre attempt to elude police.

New York police were initially notified of an erratic driver approaching the Holland Tunnel, but it was what happened when the car arrived in New Jersey that makes this case noteworthy.

Port Authority police finally spotted Robert Musso’s black Chevrolet when he emerged from the tunnel and attempted to pull him over.

He continued driving, proceeding to the westbound ramp of Route 139 before finally pulling over.

Once the police vehicle pulled in behind him, Musso allegedly put his car in reverse and accelerated backwards, injuring the officer in the vehicle.

He was transported to Jersey City Medical Center and other officers began field sobriety tests of Musso, who collapsed into a police officer’s arms.

The police report notes that Musso blew a .20 on a breath test, or two and a half times the legal limit, and also had several bottles of pills in his car, including Xanax.

He’s been charged with DWI and drug possession, reckless driving, and assaulting an officer- and is obviously in a very serious legal situation.

Even in the best of circumstances, a DWI charge can profoundly impact your ability to conduct your life, and frequently results in a painful cycle of DWI conviction, license suspension, and then subsequent charges and suspensions if you’re caught driving on a suspended license.

91-Year-Old Sentenced for DWI in New Jersey

A 91-year-old resident of Clifton, New Jersey, has pleaded guilty to charges of drunk driving in a Mount Olive Township courtroom.

Richard Johnston was spotted driving the wrong way on Route 46 back in March and police were called.

Officer Christopher Saunders responded and located the vehicle in the parking lot of a gas station that was closed for the night.

Saunders administered field sobriety tests for Johnston, who was taken into custody and later provided a breath test at the police station.

Johnston was charged with DWI and released to a sober driver.

On August 1, he told Judge Brian Levine that he had been drinking before the incident.

Levine followed the law, but it doesn’t appear that he threw the book at Johnston, possibly because of the man’s age.

Johnston was fined $254 for the DWI, ordered to pay a $250 surcharge, plus another $75 to the N.J. Safe Neighborhoods Program, $50 to the N.J. Victims Crime Compensation Board, and $33 in court costs.

Johnston’s license was suspended for three months because of DWI, as well.

It’s hard to say exactly how much Johnston’s life will change as a result of a DWI conviction at the age of 91, but for people who commute to jobs, take kids to school, and have to be available to pick up groceries and attend to myriad daily activities, a lengthy license suspension can be crushing.

Report Finds New Jersey DWI Laws “Lenient.” What?

A report out from the personal finance website WalletHub claims that New Jersey’s DWI laws and enforcement are among the most lenient in the nation.

This will come as a surprise to the thousands of New Jersey drivers who’ve been caught up in the cycle of a DWI conviction, a license suspension, being caught driving on a suspended license, and ending up off the roads – or, more likely, driving illegally – and facing a seemingly endless period of suspension and fines.

WalletHub ranked states according to a variety of metrics and found that New Jersey, where DWI is a traffic offense rather than a criminal offense, came in 45th among the states in terms of criminal penalties, but 13th in terms of minimum jail time for a first offense and 6th in the nation for how long past DWI convictions will factor in subsequent charges.

That alone should tell us there’s something screwy with their analysis. We also rank 11th in average insurance rate hikes after a DWI conviction, and 14th for minimum fines for a first offender.

The truth of the matter is that New Jersey has some of the most unforgiving DWI laws in the nation.

Because our state doesn’t allow for conditional or hardship licenses once you’re convicted, many drivers are forced to take to the road without a license to get to work, school, and take care of their families.

This puts them at risk of additional penalties if they’re caught driving on a suspended license, including additional periods of suspension and ever-increasing fines.

It’s a trap that’s caught far too many drivers in our state.

NJ Woman Drives Drunk To Police HQ After DWI Arrest

Police in Lacey, New Jersey faced an odd situation on August 3. Overnight, they had arrested Melony Gilchrist, of the Forked River neighborhood, on suspicion of DWI and took custody of her vehicle, as allowed by John’s Law. Under John’s Law, police can impound a vehicle for up to 12 hours after a DWI arrest, while the drunk driver is generally released to a sober driver, returning later to retrieve their vehicle.

This seem to be more or less the story here. Gilchrist’s car was held after she was released, and fourteen hours after her arrest, she drove back to the police station to pick up the vehicle.

The only problem for her was that police quickly realized that Gilchrist was drunk again. Officers in the station administered a sobriety test, and promptly arrested her for the second time that day, for her second DWI charge in less than 24 hours. She was also charged with reckless driving, and released, presumably to a sober friend. There was no word on the status of either of her cars.

While stories like this have an element of comedy, the fact is that a driver facing one or multiple DWI charges needs a good lawyer to protect them from the worst consequences of conviction.
