Napping Bayville Man Nabbed for DWI in New Jersey

August 11, 2017 by Matthew Reisig

Everybody needs a good nap now and then, but for one Bayville man, some poor choices beforehand may cost him big.

Around 10:00 p.m on June 15., several police officers, including a sergeant and a detective, stopped in at the QuickChek off of Route 9 in Bayville.

They discovered a car in the lot with an unresponsive man lying inside and began to try to rouse him.

It must have been a rude awakening.

According to local media, a police investigation revealed that he was drunk, and police concluded that he had arrived at the QuickChek that way.

He was arrested and taken to police headquarters in Berkeley Township, where he was charged with DWI.

He was later released pending his court date, and his car was impounded pursuant to John’s Law.

Cases like this just go to show that a DWI can happen even while you’re sleeping it off.

If you’ve been arrested for DWI while sleeping in your car in New Jersey, get experienced help right away.

Matthew Reisig has helped more than 1,040 New Jersey drivers avoid conviction on DWI and related charges.

Manville NJ Man Arrested for DWI While Drinking and Driving

August 11, 2017 by Matthew Reisig

The most common DWI arrests involve someone who becomes intoxicated at a location, perhaps a bar or a party, and is then stopped by police for traffic infractions.

In a good portion of these cases, there may be additional alcohol in the car.

In a fraction of those cases, the driver will still be consuming alcohol as they’re attempting to operate their vehicle.

That’s what police say Ricky Soper, 51, of Manville was doing as he proceeded through Bedminster on June 14.

Police received calls after 10:30 in the morning of a blue Ford F150 speeding along Route 206 in Bedminster and eventually stopped the vehicle on I-287 southbound at mile marker 21.6 at 10:45 a.m.

Investigation revealed that Soper was not only intoxicated, but had an open container of alcohol in the car, from which he was drinking.

He was charged with DWI, careless driving, reckless driving, obstructed windshield, plus summonses for the open container and consumption in a motor vehicle.

In general, the more pieces of evidence of drunk driving that exist, the more difficult it is to beat a DWI charge, but that doesn’t mean that you have no hope.

An experienced New Jersey DWI lawyer can make a big difference in your case.

Public Records Request Shows NJ Internal Affairs Cop DWI at 3X the Legal Limit

August 11, 2017 by Matthew Reisig

An open records request made by news outlet New Jersey 101.5 is giving the public a first view of the extent to which police officers have themselves been brushing up against New Jersey’s DWI laws.

In at least one newly discovered case, reporting requirements imposed by counties seem to not have been properly followed.

That appears to be the case for a Union County Sheriff’s Office captain whose job it is to investigate allegations of wrongdoing by fellow cops.

The night of April 9, William Bukowski’s Chevrolet Tahoe swerved out of his lane of traffic and struck a parked Chevrolet Colorado, hitting it with enough force to send the Colorado across the street and onto a nearby lawn.

Bukowski told responding officers that he reacted when a deer ran in front of his car, but subsequent investigation revealed that his blood alcohol level was .22 percent, or almost three times the legal limit.

In Union County, a rule was implemented after a tragic 2015 case where a Linden police officer killed two men in a wrong-way drunk driving crash.

The rule requires that DWI and other misdemeanor charges incurred by police officers must be reported to prosecutors.

Bukowski, 47, was charged with DWI and careless driving, and is awaiting his case to be heard in Westfield Municipal Court.

Sheriff Joe Cryan, who is vying for a state Senate seat this fall, declined to comment on what he described as a personnel matter, and did not elaborate on whether Bukowski’s case had been properly forwarded to the local prosecutor’s office under the existing rule.

A DWI charge can have serious impacts in all areas of your life.

Clooney Foundation Executive Curses Up a Storm at NJ DWI Stop

August 11, 2017 by Matthew Reisig

A car that was swerving and stopping erratically in the Holland Tunnel was stopped by Port Authority Police on the New Jersey side, producing a memorable encounter when the driver launched into a profane tirade against the officers.

Brenna Sermoneta, who works as the Director of Operations for the Clooney Foundation for Justice, wasn’t pleased when she was pulled over after police saw her car swerve across lanes in the tunnel around 9:30 on a Tuesday night.

After administering a field sobriety test, which Sermoneta failed, police took her into custody, prompting the woman to scream, “Get these f—— handcuffs off me!”

She was charged with DWI and reckless driving, and a breath test revealed that her blood alcohol content was well over the legal limit.

It’s unclear whether her employer, which advocates for people being abused by oppressive governments, will take any disciplinary action against her.

Many employers have policies in place to address issues like DWI, but in general, the more public a role a person has, the more likely they are to face issues at work.

If you’ve been stopped for DWI in New Jersey, don’t take chances.

Champion Bodybuilder Gains DWI at New Jersey’s Newark Airport As She Eats Cake

August 11, 2017 by Matthew Reisig

Port Authority Police had an odd experience in June when a driver swerved her way on a blown tire into Newark Airport.

They received multiple reports of a black Nissan Altima hitting curbs and guardrails – one of these collisions blew the tire on the car – that had just taken the exit to the airport around 10:30 that night.

By the time they caught up to it, the car was stopped at the airport and the driver, 31-year-old Dehabah R. Sylvester of Bloomfield, was chowing down on some cake.

Sylvester, who is the NPC Garden State bodybuilding champion, told police that she was pausing in her travels to eat and that she’d be on her way soon.

She appeared to be unaware of the flat tire or the fact that she’d been driving on the rim for quite a distance.

After a series of failed sobriety tests, Sylvester was arrested and charged with DWI and reckless driving.

A breath test revealed that her blood alcohol level was more than twice the legal limit.

Her car was impounded after the DUI arrest.

A DWI charge is never a laughing matter, and can have serious personal and professional ramifications.

New Jersey Man In Trouble in New York After Drunk Driving in Lincoln Tunnel

August 11, 2017 by Matthew Reisig

You’d think that driving drunk through a closed section of the Lincoln Tunnel would be enough, but when an NYPD officer stopped a 43-year-old driver who was going through the center tube of the tunnel in the overnight hours of May 28, the man came up with more ways to get himself in trouble.

First, he provided a New Jersey driver’s license to them that turned out to be fake.

They later determined that his actual New Jersey driver’s license was suspended, and because of his bloodshot eyes and the smell of alcohol on his breath, police breathalyzed him and determined that his blood alcohol level was .145, nearly twice the legal limit.

While the offense happened in New York, the man is likely to face significant penalties here at home.

There are even circumstances where a second or subsequent stop for driving on a license that was suspended for DWI can result in felony-level charges in New Jersey, though because this stop happened out of state, it’ll be New York, not New Jersey, prosecuting a case under its laws.

Wherever you get stopped for drunk driving, working with an attorney at home is a good idea.

There are ways to minimize the damage, and an experienced DWI defense lawyer can help.
