Stoned PA Driver Gets New Jersey DWI

Not all drunk driving arrests result from drinking.

For one Pennsylvania man, it was allegedly being high on marijuana that prompted his arrest for driving while intoxicated.

On October 29, Hackettstown police stopped a vehicle on Route 182 for a run-of-the-mill moving violation.

However, when the officer approached the car and began talking to the driver, he noted a strong odor of marijuana coming from inside.

A subsequent search revealed that the driver, Gregory Hatcher of Downington, Pennsylvania, was in possession of a glass pipe appropriate for smoking marijuana, three joints, and a plastic baggie containing what police believe is marijuana residue.

Hatcher, 43, has been charged with DWI, expired registration, maintenance of lamps, possession of paraphernalia, possession of under 50 grams of marijuana, and driving under the influence of marijuana in NJ.

All in all, it was a bad night for Hatcher, who will likely be dealing with legal headaches for months to come.

If convicted, he may face jail time and will certainly lose his license and pay stiff fines for the misadventure.

NJ Man Faces Florida DUI – What Happens When He Comes Home?

Penalties In New Jersey When You Receive A DUI Out Of State During Vacation

Vacations are great, but for one East Orange man, a family adventure to Florida took a wrong turn when he was pulled over for driving without his headlights overnight in mid-October.

Marion County Deputy Gary Miller pulled Joseph T. Dent over and noticed a strong odor of alcohol in the vehicle, which also contained Dent’s wife and 10-month-old child.

Dent said he hadn’t been drinking, but had taken a Xanax earlier in the evening.

Miller asked Dent to perform a series of field sobriety tests, during which Dent took an incorrect number of steps, failed to touch his finger to his nose, and recited the alphabet incorrectly.

He was taken to the Marion County Jail, while his family was taken to a local motel.

Assuming he’s convicted, what happens to Dent, and other New Jersey drivers dealing with out-of-state drunk driving charges?

Well, in most cases, penalties like a license suspension will carry over to New Jersey.

An interstate compact that most states are party to gives local authorities in the jurisdiction where you’re convicted the ability to notify New Jersey’s motor vehicle commission of a DUI conviction, and the MVC will notify you in writing that your New Jersey driver’s license is suspended.

There are sometimes options to appeal the decision, but it’s rare to succeed in such an action on your own.

Hearing Scheduled for Review of 20,000 NJ DWI Convictions

Investigators revealed that a State Police Officer had been improperly calibrating Alcotest devices for years back in 2016.

Thousands of New Jersey drivers who had been convicted of DWI after 2008 in five counties are waiting to learn whether their convictions could be thrown out.

Now, the state has a timeline to decide what happens, and for many, the holidays may be a happier time than they planned.

According to reports from last year, Sergeant Marc Dennis, a former coordinator with the State Police’s Alcohol Drug Testing Unit, routinely skipped a temperature calibration on Alcotest devices in Middlesex, Monmouth, Ocean, Somerset, and Union counties over a period of eight years.

Some 20,000 drivers who were convicted of DWI in those counties during that period have now been notified that their cases are under review by a retired state supreme court appellate judge.

On November 28, he will rule whether the convictions can be supported based on the mis-calibration.

It’s possible that some or all of the impacted drivers will find their records wiped clean.

Drunk New Jersey Man Drives Wrong Way on Long Island Expressway, Then Pulls a U-Turn

In this week’s installment of “driving the wrong way gets you busted for drunk driving,” we have somewhat of a doozy.

Early on Saturday morning, Jaime Rivas, 56, of Haddonfield, New Jersey, provoked 911 calls from nearby drivers when he took off down the Long Island Expressway near Syosset – going the wrong way.

Police responded right away, and caught sight of Rivas’s 2007 Mercedes Benz as it drove eastbound in the westbound HOV lane, passing vehicles as it went.

Apparently Rivas realized something was wrong, because he then executed an extremely dangerous U-turn across all traffic lanes, before stopping on the shoulder close to Exit 44.

Police descended on the vehicle, finding Rivas himself with bloodshot eyes, slurred speech, and smelling of alcohol.

He is facing a host of charges in Nassau County, New York, including DUI, reckless endangerment charges, and driving the wrong way.

Rivas’s story is just another reminder that sometimes the best course of action is to call a cab.

For years, the focus was primarily on establishing a quasi-legal category for medical marijuana, rooted in compassion for patients in need. However, recent years have seen a dramatic shift in energy, with a strong push to remove legal prohibitions on recreational marijuana use.

Several states, including Colorado, Massachusetts, Washington State, Oregon, Alaska, Nevada, and Maine, have already abandoned the criminalization of recreational marijuana use. As New Jersey contemplates the possibility of becoming a recreational use state, one pressing question arises: how will this change affect Driving While Intoxicated (DWI) cases involving marijuana?

When it comes to alcohol, standardized testing methodologies have been developed and can be applied relatively impartially. Breathalyzer tests can provide clear evidence of a driver’s blood alcohol concentration, making it easier to determine impairment. However, marijuana presents unique challenges. However, cases involving drug impairment, particularly marijuana, can be more challenging to prosecute due to the absence of standardized testing methodologies and the reliance on observations and expert testimony.

Mahwah Man Arrested for DWI Twice in One Day

If DWI arrests were a competitive sport, a 71-year-old Mahwah man would be in contention for the gold.

First, Richard B. Haskell was found in his car by police on the morning on September 23.

He was passed out at Suraci’s Pond, and neighbors had complained about an unresponsive person in a vehicle there.

Haskell had a bottle of alcohol between his legs, and the responding officer, Sgt. Timothy Shoemaker, reported that he could clearly smell the odor of alcohol on the man’s breath.

Shoemaker asked Haskell to perform a field sobriety test, which he failed. He then was taken into custody on suspicion of DWI.

At the station, Haskell’s blood alcohol concentration was found to be .21 percent. He was charged with an open container violation and DWI, then released to a sober driver.

Around lunchtime, Haskell pulled into the police station in a different vehicle and came inside to find out when his first vehicle, which was impounded after his arrest, would be released.

Police noticed that he still appeared to be intoxicated. They performed another round of field sobriety tests, which he again failed.

His blood alcohol concentration was recorded as .14 percent.

Haskell was then charged with a second count of DWI just hours after his first, and will appear in Ramsey Municipal Court on Oct. 24.

Some DWI stories are funny to read, but they’re never funny to the person cited.
