Ramsey Police Sergeant Faces DWI Charge After Crash in NJ

From the pictures, it’s hard to believe that the two men in Vasili Pieratos’s Mercedes Benz walked away from a devastating crash in Park Ridge, but luckily, they did.

Pieratos, 43, a police sergeant in Ramsey, lost control of the car as he came around a curve on Kinderkamack Road in the early morning hours of June 14.

The car left the road, went through a yard, struck a tree, and rolled over before finally coming to rest in a second yard.

Pieratos and his passenger, also a police officer, were able to get themselves out of the vehicle without help from police and fire crews who arrived on the scene after homeowners in the area called it in.

The driver’s blood alcohol level was recorded at 0.19%, more than twice the legal limit for DWI.

Officer Todd Stowe, who responded to the accident, wrote in his report that, “The driver’s impairment by alcohol caused him to fail to negotiate the curve and the resultant crash.”

Pieratos was charged with DWI, reckless driving, and given a summons for an unsafe lane change.

Asked for comment by local media, Ramsey Police Chief Bryan Gurney would only provide an email saying that his officer’s DWI is a personnel matter and the department will handle the situation according to state guidelines.

It’s entirely possible that Pieratos will be able to keep his job, though his record will undoubtedly be scrutinized and play a role in final determinations.

Hazlet Man Inaugurates New Goethals Bridge Drunk Driving Offenses

Well that didn’t take long.

After the new Goethals Bridge opened in early June, replacing the old bridge in connecting New Jersey to Staten Island, it took just days for police in the vicinity to arrest a man for driving drunk – and in the wrong direction – from the bridge.

The arrest happened on the New York side of the bridge, where a 26-year-old Hazlet, New Jersey, man was driving eastbound in the westbound lane on Goethals Road around 4:00 on Sunday morning.

The car was weaving as well, and when police pulled the vehicle over, the driver was unable to perform field sobriety tests after he nearly fell down.

After refusing a breathalyzer test, he was arrested and taken to headquarters for processing.

Just because he was arrested in another state doesn’t mean the driver will suffer no hardships when he comes home.

Because of reciprocity agreements made with most other states, punishments you receive while traveling follow you back to New Jersey, and after conviction elsewhere, you’re likely to receive a letter informing you that your New Jersey driver’s license is suspended.

Judge With DWI Asks for First-Time Offender Status

Over the border in Pennsylvania, a District Judge has found herself in some hot water after a DUI stop in April.

At the time, her blood alcohol level was more than twice the legal limit, and in late May she waived a hearing on her case.

She remains on the bench, though all DUI cases on her docket have been reassigned to District Judge Thomas H. Xavios, who is notably also hearing her case.

In a bit of an irony, Scott’s lawyer told the court that the judge is applying to participate in Pennsylvania’s Accelerated Rehabilitative Disposition program, or ARD.

This is a probationary program that lets first-time offenders complete a series of requirements, including community service, payment of court costs, and other elements that the District Attorney decides are necessary.

Once completed, a first-time DUI offender walks away with a clean record and no admission of guilt.

Scott is the 29-year-old daughter of Reading’s Mayor, Wally Scott, and succeeded her dad on the bench when he retired to run for mayor.

Her lawyer insists that the case features no special treatment for his client, and that the same rules that would apply to any defendant are being applied here.

Still, for defendants who can’t afford a lawyer or meet the terms of a diversionary program, it has to look like the privileged are, as always, prevailing.

New Jersey doesn’t have a first-offender diversion program for DWI, but it does have ample opportunities to defend yourself against charges of drunk driving.

Coerced DWI Urine Test Results in MRSA Infection, $140K Damage Award in New Jersey

Police are supposed to be highly constrained by laws, rules, and well-established procedures that are in place to protect both cops and the public.

Sometimes, for reasons that appear to defy logic or any sense of propriety, these hallmark guidelines fly out the window and people are subjected to significant abuse and injury at the hands of police.

That appears to be what happened to Norma Powell of Ocean City, New Jersey, who was pulled over for erratic driving in 2012 and ended up being forcibly catheterized at a local medical center, where she was infected with MRSA.

Powell reportedly has a respiratory ailment, and when police tried to obtain a breath sample, she was unable to provide it.

Then they resorted to giving her water in an attempt to make collection of a urine sample possible, but after ten cups of water, she was still unable to produce urine for a DUI alcohol test.

At this point, police reportedly transported the woman to a local medical center for a blood draw and urine collection.

A police officer assisted a nurse at the center with a forcible insertion of a catheter, which Powell believes is the source of the infection.

Powell sued, alleging illegal search and seizure, malicious prosecution, due process violations, excessive force, negligence, conspiracy, and assault and battery against two police officers and the nurse.

Several claims were dismissed in 2015, but in March, Ocean City agreed to pay Powell $140,000 in return for her agreeing that the city admits no guilt in the matter.

None of this should have been allowed to happen in the first place, if police had simply followed their own rules.

Alleged Drunk Driver Can’t Quite Make It Through a Light

Crossing an intersection is a routine part of driving, but an intersection is also one of the most dangerous places on the road to be.

That’s something that Stephanie Gallwitz, 50, of Gillette, got a stark reminder of when she attempted to cross through Long Hill Road and Central Avenue in Long Hill Township on the night of May 4 and collided with another vehicle.

Accidents happen, certainly, but police arriving on the scene noticed that Gallwitz appeared to be intoxicated, which is a well known way to increase the risk of having an accident while driving.

Gallwitz was ultimately arrested and faces charges for DWI, reckless driving, careless driving, and refusal.

Thankfully, no one was hurt in the accident, and if she’s convicted, Gallwitz will likely be leaving the driving to others for at least a few months.

NJ Man Abandons Damaged Car, Gets Arrested for DWI

There are a lot of myths about what the police can and can’t prosecute under New Jersey’s DWI statutes.

One is an enduring belief that if police find you outside of your vehicle, they will be unable to prove in court that you were operating the car intoxicated and the charge will have to be dismissed.

While this may have some air of common sense to it, it is important to understand that in New Jersey, that’s not how things work.

Karl Wrede, 29, of Randolph is learning that the hard way.

On the afternoon of May 22, Wrede allegedly drove drunk and somehow damaged his car significantly.

He abandoned the vehicle on the shoulder of West Mill Road in Washington Township, prompting local police to be called to the scene to investigate the abandoned car.

They tracked Wrede down, determined that he had operated the vehicle while impaired, and he was arrested for DWI and refusal.

He was later released to a sober adult and has a court date on the calendar.
