Drunk Man Tries To Escape To NY After DUI Accident

November 27, 2019 by Matthew Reisig

Man Attempts Barefoot Escape to New York After Drunk Driving Accident

A New York resident attempted an innovative evasion of police after flipping his vehicle in Mahwah, New Jersey, on November 27. Officers found him walking alone, barefoot and splattered with mud, less than a mile from the New York state line.

Nicholas Panebianco, 26, lives in Airmont, New York, and after Mahwah police finally found him – his flipped 2017 Dodge pickup truck had been called in earlier – he confessed to having been driving the overturned truck and, according to Officer Christopher Fasulo, had a “strong odor of alcohol” on his breath.

Upon discovering the unoccupied truck, which was lying on its side in the woods near the intersection of Miller Road and E. Mahwah Road, police called in a K-9 officer to help find the driver. He had apparently exited the wrecked truck and then, according to a witness, disappeared into the woods. He was found on Airmont Avenue, apparently having decided to walk home across the state line.

Panebianco was ultimately taken to Hackensack University Medical Center for observation, and has been charged with DWI, reckless driving, leaving the scene of an accident, and failing to report an accident.

If you’re facing DWI charges in New Jersey, you need experienced help right away to limit your exposure to our state’s tough drunk driving penalties. Call Matthew Reisig today at 732-378-9272 for a free consultation with an experienced New Jersey DWI defense lawyer.

Women Facing Charges After Taking Turns Driving Drunk

November 27, 2018 by Matthew Reisig

Attorney For Fighting NJ DUI Case With Multiple Drivers

Hoboken Police, responding to a call about multiple car crashes involving parked cars, found a pair of women who had allegedly been alternating driving chores in a small-scale drunk driving spree. Inside the car, officers found 23-year-old Janelle Green, a New Jersey resident, behind the wheel and 24-year-old Jamila Banks, a resident of Alexandria, Virginia, in the passenger seat.

According to the two women, Banks had been driving the car but hit two parked cars as she went. Perhaps recognizing that she shouldn’t be driving, she turned the wheel over to Green. Unfortunately, Green was also allegedly intoxicated at the time, and she went on to strike at least two more parked vehicles.

Hiring A DUI Lawyer To Fight New Jersey Drunk Driving Charges

Both women were taken into custody and charged with DWI in a school zone. Looking at the bright side, no one was injured in the incident, including Green and Banks, but both will have a fight on their hands to push back on this novel DWI story.

If you’ve been arrested for DWI in New Jersey, an experienced DWI defense attorney can make a big difference for you. Call Matthew Reisig today at 732-378-9272 for a free consultation with an experienced New Jersey drunk driving defense attorney.

Galloway Man Gets DWI After Repeatedly Passing in No-Passing Lane

November 21, 2018 by Matthew Reisig

No Passing Zone Violation Leads To DUI Arrest In NJ

As is so often the case, it’s the minor stuff that ultimately leads intoxicated drivers to get into trouble. For Kyle Francis of Galloway Township, while allegedly driving drunk was the source of his issues, his decision to pass multiple cars in a no-passing zone seems to have led him to crash his Chevy Equinox into a Nissan Sentra around 5:15 p.m. on April 2 as he illegally proceeded down South York Road.

The Sentra was turning when Francis struck it, and the driver was transported to AtlantiCare Regional Medical Center with minor injuries.

Francis has been charged with DWI, reckless driving, and improper passing, but prosecutors say more charges may be forthcoming as they continue their investigation.

In DWIs where a person is injured, police have far more incentive to leave no stone unturned in their search for additional information, and it’s possible that Kyle Francis’s ultimate legal matter will be far more serious than traffic violations.

Jets’ Donahue Into Rehab After Lincoln Tunnel DUI Crash

November 7, 2018 by Matthew Reisig

Arrested for Drunk Driving In New Jersey After A Vehicle Crash

A wrong-way crash in the Lincoln Tunnel in Weehawken wasn’t the first drunk driving case that Jets linebacker Dylan Donahue had been party to since being drafted into the NFL last May.

Just ten days after going pro, Donahue flipped his SUV while allegedly driving drunk in his hometown of Billings, Montana.

Police there claim that his blood alcohol content was recorded at 0.137, far above the .08 legal limit there and in New Jersey.

Then, in February, he was arrested for drunk driving by New Jersey police after the Lincoln Tunnel incident.

That sent him, apparently with the full support of his team, into rehab.

Donahue’s agent, Gary Uberstine, released a statement that read in part, “Dylan recognizes the seriousness of these issues and has voluntarily taken some important initial steps to deal with them.” The Jets say that he’ll be welcomed back when he’s healthy again.

The team has stood by players in the past as they dealt with substance abuse issues and got their lives together.

The National Football League, on the other hand, will likely issue Donahue suspensions as a disciplinary matter. What judges in Montana and New Jersey, where Donahue’s cases are still pending, have to say remains to be seen.

17-Year-Old Faces DWI After Lacey Traffic Stop

November 1, 2018 by Matthew Reisig

DUI Attorney For Underage Drinking Charges In New Jersey

Underage drinking is illegal in New Jersey, so drivers who are under 21 face a slightly different landscape in DWI law, as one Forked River 17-year-old is learning.

Lacey police stopped the teenage male driver around 10:30 p.m. on March 18, near the intersection of Arlington Avenue and Alpine Street.

Officers Michael Moeller and Scott Keefe discovered the young man, apparently intoxicated, and with an open container in the vehicle with him.

He was taken to police headquarters and charged with DWI, possession of an open container of alcohol in a motor vehicle, reckless driving, and other traffic infractions.

The problem for any teen in this situation is that for underaged drivers, a blood alcohol content of just 0.01% is enough to trigger charges.

Penalties for underage drivers facing drunk driving charges include 90 days without your driver’s license, mandatory attendance at an alcohol and driver safety program, community service, and fines of up to $500.

Your insurance company will also have a lot to say about this turn of events, and if they don’t cancel your policy, you can expect to pay a lot more for the pleasure for years to come.

Fighting Underage DUI Charges With Experienced NJ Attorney

DWI is tough for teen drivers, who are finally experiencing independence, but still prone to making poor decisions.

If your child has been arrested for DWI in New Jersey, talk to an experienced DWI defense lawyer to see what can be done to help.

New Jersey’s Newest DUI Law: Drunk Droning

June 19, 2018 by Matthew Reisig

If you’re someone who enjoys an adult beverage while flying your drone, you might need to reconsider for a minute.

On his last day in office, outgoing governor Chris Christie signed 109 bills into law, including one that makes it a crime to operate a drone with a blood content over 0.08.

This is the same standard applied to drivers and boaters, and the penalties for violating the new law is up to six months in jail, a $1,000 fine, or both.

Unlike DWI, which is prosecuted as a moving violation, drunk droning is a disorderly persons offense, comparable to a misdemeanor in other states.

The law also makes it a crime to fly drones near prisons or to use them for the taking of wildlife.

Operating a drone with a BAC over .08 is against the law.

If you find yourself on the wrong end of a Drunk Droning charge, get experienced legal help right away.

The law may be new, but ignorance is no defense.
